For Filipino citizens who wish to solemnize their marriage at the Philippine Embassy
Articles 10 and 75 of the Family Code of the Philippines (Article 75 and Article 10) provide that marriage may be solemnized abroad by the Consul-General, Consul, or Vice-Consul when the marriage is between Filipino citizens, male and female. The consular officer shall perform the issuance of the marriage license and the duties of the local registrar and of the solemnizing officer with regard to the celebration of the marriage.
REQUIREMENTS:
- Personal appearance of both contracting parties
- Duly accomplished application forms for Marriage License/Certificate
- Original and one (1) photocopy of the documents below should be submitted to the Embassy upon application for marriage license. Original documents will be returned to the contracting parties after solemnization of marriage.
- Valid Philippine passport as proof of Philippine citizenship of the contracting parties. (present original and submit photocopy of information page with photo)
- Duly authenticated Certificate of No Record of Previous Marriage (printed on security paper) obtained from the NSO (Certificate of No Marriage Record – CENOMAR- printed on NSO security paper and authenticated by the DFA. Please note that the CENOMAR is valid for only six (6) months from the date of issuance by the NSO.)
- Duly authenticated Certificate of Live Birth (printed on security paper) obtained from the NSO (on NSO security paper and authenticated by the DFA).
- Pursuant to Article 14 of the Philippine Family Code, persons between the ages of eighteen (18) and twenty-one (21) must secure an Affidavit of Consentto their marriage of their father, mother, surviving parent, or guardian, or persons having legal charge of them, in the order mentioned. Further, under Article 15, persons between the ages of twenty-one (21) and twenty-five (25) must submit an Affidavit of Advice from their father, mother, surviving parent, guardian, or persons having legal charge of them, in the order mentioned, regarding their intended marriage. (Affidavit may be accomplished and notarized at the Philippine Embassy for separate fee.)
Please note that the Affidavit should be notarized and then authenticated by the Clerk of Court of the Regional or Metropolitan Trial Court and by the DFA in Manila.
- The contracting parties are advised to make sure that at least two (2) witnesses above twenty-one (21) years old, preferably one male and one female, are present during the Solemnization of Marriage. The date of the marriage should be arranged and finalized with the Consular Section.
- Basic Fees: Solemnization of Marriage – Tk 5,100.00
Authentication of Marriage Contract – Tk 2,125.00
Note:
- Documents need to be submitted in triplicate.
- After submission of requisite documents by both contracting parties, a ten (10) day publication of The Intent to Marry by both parties shall be posted at the Embassy. If there are no objections received, the Solemnization of Marriage will be performed by the Consul General, Consul or Vice Consul of the Embassy on a scheduled date, within the Embassy premises.
- Contracting parties as well as their guests are requested to be in their semi-formal attire.
ADDITIONAL REQUIREMENTS:
For divorced applicants:
- Report of Divorce issued by the Philippine Embassy (if divorced in the jurisdiction) or by another Philippine Embassy or Consulate in the country where the divorce was finalized. (present original and submit photocopy)
For applicants whose marriage was annulled:
- Certificate of Finality of Decision and Court Order/Decision authenticated by the DFA (present original and submit photocopy)
- Amended Marriage Contract (with annotation of the annulment of marriage) on NSO security paper authenticated by the DFA (present original and submit photocopy)
For widows/widowers:
- For those whose spouse died in the Philippines, present original and submit certified true copy of Death Certificate issued on NSO security paper authenticated by the DFA or Court Order of presumptive death (in case spouse had been missing for a number of years and has been presumed dead) authenticated by the DFA.
- For those whose spouse died outside the Philippines, present original and submit certified true copy of the Death Certificate with English translationand legalized or authenticated by the Ministry of Foreign Affairs of the country where the Death Certificate was issued.
